These Terms govern all purchases made through www.laherba.co.uk and comply with UK consumer protection law, including the Consumer Rights Act 2015, Consumer Contracts Regulations 2013, and the E-Commerce Regulations 2002.

Your statutory rights are not affected.

2. SCOPE AND ACCEPTANCE OF THESE TERMS

By placing an order on our Website, you:

a) Confirm you are at least 18 years old
b) Agree to be bound by these Terms
c) Confirm you have read our Product Disclaimer, Privacy Policy, Cookies Policy and Age-Verification Policy

If you do not agree with these Terms, you may not use the Website.

We may amend these Terms at any time. Changes do not apply to orders already accepted.

3. NATURE AND CLASSIFICATION OF OUR PRODUCTS (CRITICAL LEGAL NOTICE)

3.1. Important Product Disclaimer

Our products — including but not limited to Rapé (Hapé) blends, Sananga, Wayusa, ceremonial cacao, herbal mixtures, resins, botanicals and related cultural artefacts — are sold EXCLUSIVELY as:

Collector’s items
Cultural, historical or ethnobotanical specimens
Research or educational artefacts
Decorative items

3.2. Not Classified as Foods or Medicinal Products

Under UK law, these items are NOT:

Foods or beverages
Herbal products for consumption
Medicines or medicinal products
Nutritional supplements
Tobacco, incense for inhalation, or smoking products
Cosmetic products
Items intended for internal or therapeutic use

They must NOT be ingested, inhaled, applied to the body, or used internally in any form.

3.3. No Health Claims

Any historical or cultural information is provided solely for educational purposes and must not be interpreted as:

A health claim
Medical or therapeutic advice
A recommendation for consumption or internal use

We do not provide instructions for ingestion, inhalation, ritual use, or application.

3.4. Buyer Responsibilities

By ordering, you confirm that:

You understand the intended non-consumable purpose
You will not use the products in any manner inconsistent with these Terms
You will keep products away from minors
You will comply with all applicable local laws
For international orders, you have verified that products are legal to import and possess in your jurisdiction

We accept no liability for misuse or unlawful use.

4. AGE RESTRICTION AND VERIFICATION

We sell only to persons aged 18 or over.

We operate a mandatory age-verification policy, which may include:

Identity document request
Digital age-verification tools
Age-verified courier delivery (“Challenge 25”)

If age cannot be verified, the order will be cancelled and refunded (minus any costs already incurred).

5. ORDERING PROCESS (E-COMMERCE REGULATIONS COMPLIANT)

5.1. Steps to conclude the contract

b) You provide necessary details and select delivery and payment method
c) Before checkout, you may review and correct errors
d) You submit your order by clicking “Place Order”

This constitutes an offer from you.

5.2. Order Confirmation

After submission:

You receive an automatic receipt email – not acceptance
The contract is formed only when we send you an Order Acceptance / Dispatch Confirmation

We may refuse orders where:

Legal requirements are not met
Age verification fails
Products are unavailable
Fraud or misuse is suspected
Prior contracts were breached

5.3. Storage of contract

We do not store accessible copies of the contract.
Please retain your order confirmation emails.

6. PRICES AND PAYMENT

All prices are shown in GBP (£) and are final.

We are not VAT-registered in the United Kingdom.

A minimum order value of £10 applies.

7. DELIVERY

7.1. Delivery Times

We usually dispatch within 1–2 working days of acceptance.
All orders will be delivered within 30 days, unless otherwise agreed.

If we cannot deliver within 30 days, you may cancel and receive a full refund.

7.2. Delivery Options

Delivery times: typically 3–5 working days (UK), 5–14 days (international).

7.3. Customer Obligations

You must:

Inspect packaging at delivery
Report visible damage immediately to the carrier
Accept delivery or arrange redelivery

7.4. Failed Delivery

If you do not collect or accept delivery and the parcel returns to us:

We may deduct reasonable return and handling costs (£6–£10) from your refund.

8. INTERNATIONAL ORDERS

You are responsible for:

Verifying import legality in your country
Paying customs duties, taxes or clearance fees
Ensuring products comply with local laws

We are not liable for:

Seizure by customs
Delays
Returns caused by regulatory restrictions

9. YOUR RIGHTS UNDER UK CONSUMER LAW

9.1. Faulty Goods – Consumer Rights Act 2015

If goods are faulty:

Within 30 days → full refund
Within 6 months → repair or replacement; if not possible → refund
After 6 months → repair, replacement or partial refund (you may need to prove the fault existed at delivery)

9.2. 14-Day Right to Cancel (Cooling-Off Period)

Under the Consumer Contracts Regulations 2013, you may cancel within 14 days of receiving your goods without giving a reason.

Exceptions

You cannot cancel if:

Goods sealed for health/hygiene reasons were opened
Goods were mixed with other items post-delivery

This includes ethnobotanical samples packaged in sealed bags or containers.

14. LIMITATION OF LIABILITY

Fraud or fraudulent misrepresentation
Any rights that cannot be excluded under UK law

To the extent permitted by law, we are not liable for:

Losses arising from misuse of products
Indirect or consequential losses
Losses arising from customs seizures or legal restrictions in your country
Use of products in contradiction with their declared non-consumable purpose

15. FORCE MAJEURE

We are not responsible for delays or failures caused by events outside our reasonable control, including postal disruption, customs delays, strikes, pandemics, or natural events.

16. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of England and Wales.

Courts of England and Wales have exclusive jurisdiction.
